Guide: The “Ethical Guidelines for the R&D of Driving Automation Technology” clearly states that the research and development of driving automation technology should design a sound risk monitoring and emergency mechanism to ensure that relevant responsible subjects can promptly detect, intervene in and control risks, and reduce potential threats to a reasonable and controllable range.

On July 23, it was reported that the Ministry of Science and Technology announced the “Ethical Guidelines for the R&D of Driving Automation Technology” (hereinafter referred to as the “Guidelines”), aiming to prevent ethical risks of science and technology in the process of technology research and development and product application, and promote the healthy development of this field.

The “Guidelines” clearly stipulate that the research and development of driving automation technology should design a sound risk monitoring and emergency mechanism to ensure that relevant responsible subjects can promptly detect, intervene in and control risks, and reduce potential threats to a reasonable and controllable range.

At the same time, the research, development and application of driving automation technology should establish and improve a full-life-cycle data privacy protection mechanism, and strictly follow the principles of informed consent, minimum necessity, and de-identification.

The “Guidelines” also specify corresponding ethical requirements for different types of driving automation technologies, as follows:

The advanced driving assistance stage refers to driving automation at Level 2 and below, and the responsible subject is usually the human driver.

Automated driving in the restricted stage includes Level 3 and Level 4 driving automation. The responsible subject varies according to specific operating scenarios, and both users and automated driving systems may become responsible subjects.

Automated driving in the unrestricted stage is Level 5 driving automation. Unless the user takes the initiative to intervene in special circumstances, the responsible subject of automated driving in the unrestricted stage is mainly the automated driving system.

When the automated driving system acts as the responsible subject, it should be able to clearly pursue the responsibility of the relevant natural person or legal person subject in accordance with relevant laws and regulations.

The “Guidelines” also emphasize that when releasing major research results, relevant subjects should adhere to objectivity, accuracy and truthfulness, and must not fabricate or spread false information that is inconsistent with the actual functions and effects of the driving automation system.
