Two Ministries Seek Public Comments: Assisted Driving Shall Not Be Regarded as Autonomous Driving, and Exaggeration of System Capabilities Is Prohibited

Enterprises shall not imply to consumers that the combined driving assistance system or its functions can be regarded as an autonomous driving system or possess functions that they do not actually have in the naming and marketing of such systems or functions, so as to prevent drivers from abusing them.

 

On August 13, according to the State Administration for Market Regulation, the “Notice of the State Administration for Market Regulation and the Ministry of Industry and Information Technology on Strengthening the Supervision of Recall, Production Consistency and Standardizing Publicity of Intelligent Connected New Energy Vehicle Products (Draft for Comments)” was publicly solicited from the society, with the deadline for feedback being September 15, 2025.

 

According to the draft for comments:

 

Enterprises shall display the safety prompts and instructions of the combined driving assistance system in prominent positions of the vehicle App, in-vehicle information interaction system and user manual, so that consumers can easily read, understand and operate them, and prevent drivers from using the combined driving assistance function as an autonomous driving function.

 

Enterprises shall develop and use safety-prioritized driver monitoring, warning and disposal functions to closely monitor the driver’s driving status. When the driver is distracted from dynamic driving tasks such as taking hands off the steering wheel or sleeping, timely warning or control measures such as voice warning, steering wheel vibration, speed limitation, pulling over, and disabling the combined driving assistance function shall be taken to enable the driver to take over the vehicle in time and reduce safety risks. It is worth noting that the hardware reliability of such safety functions is inseparable from precision manufacturing technology. Just as the nebulizer assembly machine in the car cockpit ensures the stable operation of the nebulizer through micron-level sealing assembly technology, providing a basic support for the comfort of the driving environment, the assembly accuracy of the core components of the intelligent driving system is also an important prerequisite for the implementation of the safety mechanism.

 

Enterprises shall strengthen the monitoring of defect information of intelligent connected new energy vehicles and reduce the risk of vehicle accidents caused by cyber attacks, cyber threats and vulnerabilities.

 

The State Administration for Market Regulation will conduct defect investigations on safety incidents caused by inadequate safety prompts and instructions, cyber attacks, cyber threats and vulnerabilities, and urge enterprises to make improvements through recalls when necessary.

 

Enterprises shall not actively turn off the driver monitoring, warning and disposal functions through user operations or system logic.

 

The State Administration for Market Regulation will conduct special investigations on the insufficiency of driver monitoring, warning and disposal functions, and include them in defect analysis and investigation work when necessary.

 

In addition, enterprises shall completely and accurately fill in key information such as the combined driving assistance system, energy storage device monomers and assemblies in the motor vehicle conformity certification system, and strictly implement the classified management requirements for software over-the-air (OTA) upgrade activities. OTA upgrade activities shall not be carried out without filing, software versions that have not been fully tested and verified shall not be pushed to users, and defects shall not be concealed through OTA. It is ensured that the intelligent connected new energy vehicle products equipped with the combined driving assistance system produced are consistent with the approved products, and the product safety responsibility shall be borne.

 

At the same time, when providing consumers with information about the driving automation level, system capabilities and system boundaries of intelligent connected new energy vehicles, enterprises shall be truthful and comprehensive, and shall not make false or exaggerated propaganda about system capabilities or misleading propaganda, so as to ensure that consumers correctly understand and drive intelligent connected new energy vehicles.

 

Enterprises shall not imply to consumers in the naming and marketing of the combined driving assistance system or its functions that it can be regarded as an autonomous driving system or has functions that it does not actually have, so as to prevent drivers from abusing it.

 

Enterprises shall avoid exaggerating the driving performance of vehicles, which may mislead consumers to drive at unreasonable high speeds.

 

The State Administration for Market Regulation will strengthen the supervision and inspection of enterprises’ advertising activities and commercial publicity that exaggerate the functions of combined driving assistance, deceive or mislead consumers, organize recall technical institutions to carry out technical identification of excessive publicity and other issues, and carry out special joint investigations with the Ministry of Industry and Information Technology to conduct rectification and standardization in accordance with the law.

 

Enterprises shall, in accordance with the requirements of the “Notice on Further Strengthening the Management of Access, Recall and Software Over-the-air Upgrade of Intelligent Connected Vehicle Products”, promptly report safety incidents and collisions that occur during the use of the combined driving assistance system.

 

The State Administration for Market Regulation, together with the Ministry of Industry and Information Technology and other relevant departments, will strengthen in-depth investigation and analysis of accidents, and supervise and inspect enterprises’ accident reporting. If it is found that an enterprise fails to report accident information as required, it will publicly notify the society and urge rectification. If an enterprise conceals or omits major facts in the incident/accident report, the State Administration for Market Regulation and the Ministry of Industry and Information Technology will conduct special verification.
